We have done our best to reduce and simplify our App's rules. Therefore, we have separated the most important points for you below, which can also be read in a complete and detailed way in the Terms of Service and Conditions below.

Furthermore, we are always available to answer any questions you may have by email at friends@husky.io or by chat on our App or website https://husky.io.

1) HUSKY consists, but is not limited to, a business company that allows people to use financial and administrative services in a 100% digital way, without having to go to physical locations and dealing with any needs remotely, either through the application or by other means linked to the internet.

2) HUSKY has several partners in the services it makes available to its customers, whether financial and/or administrative services, so in certain situations, it may request your acceptance or your electronic or digital signature to proceed with some of the available offers.

3) To use HUSKY's services, Customers must pay amounts, either as a percentage of transactions carried out, monthly fees, or specific fees, depending on the service to be contracted. These values are variable, will be informed in a specific term at the time of hiring, and will be charged in Brazilian currency (Real).

4) To use the exchange services offered by HUSKY, you provide and electronically sign a power of attorney for it to act as an exchange correspondent on your behalf after accepting the Terms and progressive use of the application and services.

5) You declare that the nature of the services you provide is exactly as described in our application by you. Such information will also be highlighted in the Terms of Service, in item 14.6.

6) We try hard to make/or we strive our service safe, but we still recommend that, before downloading any content, you install antivirus protection programs and have secure passwords, and never share them with third parties.

7) Our Terms of Service may change, but you can always access the most up-to-date version on our app or through the website. Also, if we are going to take any action that the law requires your authorization, you will receive prior notice so that you can accept or decline.

8) We have a Privacy Policy that addresses what we do with your personal data. It is very important that you read and understand this document as well!

CUSTOMER AGREEMENT - HUSKY SERVICE TERMS AND CONDITIONS

FOR CUSTOMERS USING ONLINE FINANCIAL AND ADMINISTRATIVE SERVICES.

This Agreement (the “Agreement”) defines the terms and conditions that govern the use of financial services of assistance and administration of values, support in exchange operations, administrative to legal entity accounting, and others that may be added and described in these terms, exercised by hired (the “Service”); You can access the Service through the website, on its page located at https://husky.io (o “Site of Services”) or through the HUSKY mobile apps. As used here, “HUSKY,” “We” e “Our,” means the HUSKY and its subsidiaries that belong to the same economic group, “Your”, “You” e “Client” means the person, natural or legal, who is using the Services described here.

The HUSK is registered under the CNPJ nº 35.486.142/0001-95, registered in Brazil, based in Avenida das Nações Unidas, nº 12.901, Bloco A, Edifício Norte, Sala 12103 X, Brooklin Paulista, São Paulo - SP, CEP: 04578-910.

This is your agreement with us. By signing up for HUSKY Services, you must read, agree and accept all terms and conditions contained in this Agreement. You agree that after accepting the virtual environment, any use you make of the Services will signify your acceptance of the Agreement, and we encourage you to store or print a copy of the Agreement (including all policies) for your record.

Please read this Agreement carefully, making sure you fully understand it before using the Services. Please note that if you do not accept this Agreement, you will not be able to use the Services.

1. Data Privacy

1.1 Protecting your privacy is very important to us at HUSKY. Your passwords are stored on HUSKY's servers in encrypted form. Our customers' information is shared only with third parties selected by us to perform the services, or in the cases required by law, as specified in the HUSKY Privacy Policy, which is available and must also be read and accepted in the act. 1.2 Sensitive information is transferred between your browser and the Service's Website/Application in an encrypted form using the Secure Socket Layer (SSL) protocol. When transmitting sensitive information, you should always ensure that your browser can validate the Service's Website certificate.

2. Technical Terms or in Foreign Language

API: Sigla para Application Programming Interface is a set of programming routines and patterns for accessing a software application or web-based platform.

Câmbio: When a person travels abroad and acquires money to use at his destination – for example, the dollar, in the case of the United States, and the yen, in the case of Japan, this acquisition is an exchange transaction. Likewise, importers carry out foreign exchange operations to exchange reais for the currency of their trading partner to pay for the items they have purchased.

These currency exchanges take place in the foreign exchange market. In it, tourists, merchants, companies, and financial institutions buy and sell foreign currency (currency) under the regulation and supervision of the National Monetary Council (CMN) and the Central Bank (BC).

Chat Online: A form of communication at a distance, using computers connected to the internet, in which what is typed on the keyboard of one of them appears in real-time on the screen of all participants in the chat.

Cookies: Small text files that are recorded on the Internet user's computer and can be retrieved by the website that sent them during navigation. They are primarily used to identify and store information about visitors.

Cryptography: Set of principles and techniques to encrypt writing, making it incomprehensible to those who do not have access to the agreed conventions.

Download: File transfer from a given server to the User's computer.

E-mail: Method that allows composing, sending, and receiving messages through electronic communication systems. It is also the expression that identifies the electronic address of a User in a computer network, allowing the sending and receiving of messages.

IP (ou Internet Protocol): Identification of each computer connected to a network.

Link: Link between documents on the Internet.

Newsletter: Type of information document, regularly distributed to subscribers and generally covering a specific topic. They are usually sent by email, which can be received after registering on a website.

Site: Internet location identified by a domain name, consisting of one or more hypertext pages, which may contain text, graphics, and multimedia information.

Transport Layer Security (TLS)/Https: Sigla de Hyper Text Transfer Protocol Secure, which in Portuguese means Secure Hypertext Transfer Protocol. It is a communication protocol used for hypermedia information systems, the basis for communicating data from the World Wide Web (www).

Vírus: Software malicious software that infects systems and computers, with the aim of causing damage, makes copies of itself and tries to spread itself to other computers, using various means.

3. Eligibility, Capacity, and Effective Registration

3.1 To use the Service, you must first create an account on our Site or Service Application and create your account as instructed by HUSKY (the “Account”). As part of your registration and to use the Service, you represent and warrant that:

3.1.1 If you are an individual, you are of legal age in your jurisdiction, but in all cases, you are at least 18 years of age. If you are under 18 years of age, you are aware that, if you are not emancipated, you will only be able to use our services if your account is created by your legal representatives, and these representatives accompany you throughout the use of the services;

3.1.2 You are not acting on behalf of a hidden shopper;

3.1.3 You are not acting on behalf of a third party beneficiary without proven authorization to do so;

3.1.4 You have full authority to enter into this Agreement;

3.1.5 You are or act with powers on behalf of the CPF/CNPJ holder informed in your profile; This CPF/CNPJ number will be used to verify the limits available with our partners and the relevant regulatory and tax authorities in Brazil and for any legal needs to guarantee the success of the transactions and customer satisfaction and this data will be kept in safety;

3.1.6 You will not be violating any law or regulation by registering with us, entering into or performing any part of this Agreement, or by using the Service in any other way;

3.1.7 All information provided by you as part of your registration and use of the Service is accurate and complete, and you undertake to inform us promptly of any changes to this information;

3.1.8 You (the “Customer”) declare that you are aware and agree that such information contained in your registration, as well as any other information identified by HUSKY, will be sent to the Financial Activities Control Council – COAF, whenever necessary;

3.1.9 You will ensure that your contact details provided at registration remain accurate and up to date. We will use these contacts to contact you whenever necessary under this Agreement or in connection with the Service. You may update your contact information at any time by logging into your Account on the Service website/application and/or requesting such change via the available online chat.

4. Transaction History

4.1 You can access the Transaction details of payments you have made and other information related to your Account by accessing the Husky app.

4.2 You will also be able to access the details of any Requests related to administrative services that you have made via Online Chat or by email, accessing the Husky application or your registered email.

5. Duplicate Accounts

5.1 HUSKY reserves the right to refuse to create duplicate accounts for the same user due to security and customer identification requirements. If duplicate accounts are detected, HUSKY reserves the right to terminate or merge such duplicate accounts without notice.

6. Identification and Verification

6.1 In order to help the government combat the financing of terrorist and money laundering activities, Brazilian law requires HUSKY to obtain, verify and record information that identifies each person to whom we provide certain types of services.

What does this mean for you?

When using our Services, we will ask for your identity (which may be a digital copy of your identity card, passport, driver's license, or other photo identification documents), tax number (CPF - Cadastro de Pessoas Físicas or CNPJ). – National Registry of Legal Entities), proof of recent address, telephone, e-mail, and other information that allows us to identify you. We may request other documents. We may also contact you if we have further questions.

6.2 We carry out the verification process and reserve the right to access various government and private databases in order to verify your information (referred to as “Electronic Identification”).

6.3 This is based on Brazilian legislation and on resolutions and circulars of the Central Bank of Brazil, more specifically on the texts cited below:

7. Services

7.1 From the Exchange Service. The Service allows HUSKY to assist you in the transmission of monetary values from a fund, account, or application to other beneficiaries (“Final Beneficiary”), which may even be located in other countries and/or to other countries, in currencies other than the Real, such as US Dollar, Euro, Pound, and others (a “Transaction”). Amounts are sent to the Final Beneficiary via electronic funds transfer, wire transfer, or other electronic methods. The way in which the Service is performed, as described here, may be changed by us at any time, without prior notice, provided that we have duly informed you of the new way so that you can continue using the Service safely. In addition, at our discretion, we have the right to refuse any user or not to carry out any Transaction, at any time, in order to guarantee the preservation of the terms defined by Law nº 9.613/1998 and related.

7.1.1 In the event that the Transaction is not concluded, a reversal will be generated to the source paying the funds in an average period of up to 15 (fifteen) business days. Such a situation, as a rule, should only happen in cases where the customer does not present all the information necessary for the completion of the service or for reasons beyond HUSKY's control, such as legal/commercial impediments of banking partners.

7.1.2 HUSKY is not obliged to explain the entire process/procedure used in each transaction individually, reserving to inform that its services may be performed by various actions, such as banking or exchange correspondent systems, cryptocurrencies, and others. Alternatives as technology development. This understanding is justified because it is the core business of the service, and the continuous and recurring identification of the means used in each transaction would make it difficult to maintain and protect the intellectual property of the business.

7.1.2.1 In any case, in order to alert you, HUSKY informs you that it is not a Financial Institution. HUSKY only performs the administrative service of assisting you in receiving amounts that would normally be received on financial platforms or even traditional Financial Institutions, then being received through other alternatives, using the intelligence, relationship, and knowledge of our team. to seek a better cost-benefit for you in a digital environment.

7.1.2.2 Also in this sense, HUSKY clarifies that, as it is not a Payment Institution or a Financial Institution, it is not responsible for issuing an Exchange Agreement for any of its customers. Therefore, you should be aware that the contracting of our services does not oblige us to present or issue any type of Exchange Agreement unless we have this document available through any partnership eventually built or legal determination.

7.1.2.3 Anyway, HUSKY clarifies that it works in search of the best conditions for you and all our customers. In addition, if necessary and requested, or if you are summoned through the legal and/or official means defined by Brazilian legislation by official State bodies, such as the Federal Revenue Service of Brazil, to provide justification for the amounts received. into account, we will promptly make available all the evidence we have with us, in order to assist in the necessary clarifications.

7.1.3 Among the various advantages and partnerships that HUSKY offers to our customers, we inform you that we are also correspondents for institutions accredited and authorized by the Central Bank of Brazil. If you want to know our list of partners, contact us at e-mail friends@husky.io.

7.2 From the Administrative Service. HUSKY also offers the possibility of facilitating its legal entity accounting, through partners and its own technology developed to streamline procedures and simplify some actions that a legal entity needs to take to be regular with the State.

7.2.1 We clarify that we are not an accounting firm nor do we have the desire to be, which is why we do not act as accountants, but only digitize the contact between legal entities that need an accountant and HUSKY's professional partner who works using our technology and support for the necessary accounting and administrative procedures.

7.2.2 In this sense, all accounting documents that need to be signed will be made by HUSKY partners, not binding HUSKY to any irregular act of these partners since we do not even have the technical knowledge to judge whether such actions are correct or not, and the Customer is aware that he may request clarification from accounting with the help of HUSKY or, if necessary, directly from accounting. To do so, simply request contact in our online chat or by email to friends@husky.io and we will assist in this contact with the partner for any necessary action.

7.3 From the Digital Account Service. HUSKY may also offer you bank account services for a legal entity in a 100% digital environment, such service is made available to facilitate the financial management of the Customer, from partners that HUSKY has.

7.3.1 In a similar sense to the previous cases, HUSKY insists on reinforcing that it is not a Financial Institution, but that it uses its technological capacity to provide its Clients with the possibility of managing a digital account of a legal entity within the HUSKY application, and it should be clear that, any questions about values or charges may be made to HUSKY, but they will be directly passed on to whoever is necessary if HUSKY does not have the legal/technical conditions to resolve it.

8. Payment Methods

8.1 As soon as your registration is completed and documents are sent, HUSKY will validate all the documentation and proceed with the contracted Service. When the Services are performed by HUSKY, they will be displayed in your virtual account that you can consult at any time through the application.

8.2 At the time of contracting the Service, the customer will define several issues, such as his bank account that he wants to receive for financial operations, type of company for administrative services, and/or any other details, in order to facilitate and expedite the performance of the Services. Also, if you want to request changes to the details of the Service, you can do so by email or through the application itself.

8.3 Payment of the amounts will be deducted from the service fee defined in item 13 of this contract, justified by the services provided.

9. Transaction

9.1 The customer subscribes to the Services described above, authorizing HUSKY to: 1) administer and receive the amounts in order to facilitate the final receipt to the customer in exchange operations; 2) digitize and facilitate all necessary and possible accounting procedures with the duly regular accountant, in the administrative services; 3) manage, invest and transfer the values of your legal entity digital account to whoever is entitled, when requested.

9.2 With respect to foreign exchange transactions, the amounts are transferred from the account of the payer directly to HUSKY or one of its commercial partners, and this receipt is managed by HUSKY through its technology, knowledge, and technical training.

9.2.1 HUSKY or one of its commercial partners converts the amounts into the currency defined by the customer and possible by HUSKY (Brazilian Real (BRL), US Dollar (USD), Euro (EUR), or others that the parties agree), whenever necessary, and transfers it to you, withdrawing only the value of the service fee described in item 13 and pre-defined with the customer for the support in the service performed.

10. Exchange Rates

10.1 We, through HUSKY, make reasonable efforts to ensure that transactions follow an exchange rate in line with the mid-market rate in global currency markets. HUSKY relies on third-party aggregated information sources and we do not guarantee that rates will be the same as any particular source searched at any given time. We are not responsible in any way if the value of the target currency, after the exchange, is lower than expected, thanks to the result of changes in the global financial markets.

10.2 HUSKY assumes all risk for the volatility of global foreign exchange markets and is responsible for any losses that the company has to the detriment of customer transactions.

11. Payment Limits in Exchange Transactions

11.1 There is currently no limit for transactions linked to exchange operations within the same calendar month, but HUSKY reserves the right to request additional documentation in cases of transfers with amounts greater than USD $3,000.00 (three thousand dollars), respecting the rule provided for in article 137, sole paragraph, of Circular 3,691/2012 of the Central Bank of Brazil, which determines: “Sole paragraph. Without prejudice to the duty to identify customers, in foreign currency purchase and sale operations up to US$3,000.00 (three thousand United States dollars), or it is equivalent in other currencies, the presentation of documentation related to the business is waived. underlying legal documents and keeping a copy of the customer's identification document.”

12. Cancelation

12.1 You can cancel your account on our app at any time. Simply request the termination of the contract with us by email. This can be done by sending an email to friends@husky.io or via the platform.

12.1.1 Once the termination of the contract with HUSKY and the deletion of your account has been requested, we reserve the right to file legal and financial information on a separate server that must be filed by law, for a minimum period of 5 (five) years. In addition, access logs (a set of information regarding the date and time of use of a given internet application from a given IP address) will also be kept confidential, in a controlled and secure environment, for a period of 6 (six) months, pursuant to Law no. 12,965/2014. The other data will be deleted and/or anonymized to avoid any violation of the Brazilian legislation on data, in particular the General Data Protection Law, Law 13.709/2018, and our Privacy Policy.

12.2 HUSKY will transfer all amounts that are still in an account or foreseen for you, deducting the service fee already provided and the contract between the parties will be terminated, with no further obligations of any of those involved.

13. Fees

13.1 Service Fees. HUSKY does not charge a fixed fee or brokerage for foreign exchange transactions but may charge a fixed fee for administrative and other financial services described in item 7. Services.

13.2 HUSKY obtains billing in foreign exchange operations from the discount in the form of a percentage applied on any monetary volume that may be transacted by HUSKY for the customer. For each Transaction, the discount is subtracted from the amount to be transacted, still in the original currency, and the remainder is delivered to the customer in the final currency, after conversion, obeying the commercial market exchange rate at the exact moment in which the amounts arriving in the possession of the HUSKY or one of its business partners. The value of the percentage applied by HUSKY is defined and informed to the Customer upon acceptance of these terms and continuity in providing the requested data, making full use of HUSKY's services.

14. Client Obligations

14.1 You are responsible for ensuring that the documents and payment details provided are correct. Once payment instructions have been made by us, Transactions cannot be reversed and we will not be liable in any way for any loss suffered as a result of the Transaction carried out in accordance with your instructions.

14.2 While it is unlikely, if you notice an error in your payment sent or received while using the Services, you must notify us immediately via the in-app support channels or email. If you become aware that you, the Final Beneficiary, have received payment in an amount above and above what you expected, you must notify us immediately, so that you immediately return any excess payment, under penalty of illicit enrichment.

14.3 You agree not to use the Services for any illegal activity, and we reserve the right to investigate any suspicious activity or in response to any complaint or reported violation. When investigating any activity of this nature, we reserve the right to report any suspected illegal activities to the relevant persons or entities in order to provide them with any relevant information, including personal data.

14.4 The Service may only be provided in accordance with applicable laws, including the laws of Brazil. You may only use the Services when permitted by applicable law. Please note that there are strict rules and sanctions regarding providing false information and misclassifying information, so please be careful when filling in your information.

14.5 By using the Service, you acknowledge that you understand the rules of the Brazilian Exchange, especially Law 4.131 of 09/03/1962, and all its modifications. In particular, you must have full knowledge of the provisions set out in paragraphs 2 and 3 of Article 23 of this Law, transcribed below:
2° – The declaration of false identity on the form that, according to the model determined by the Central Bank of Brazil, will be required for each transaction, signed by the customer and endorsed by the banking establishment and by the broker who intervenes in it.
3° – The declaration of false information in the form referred to in § 2 of this article constitutes an infraction, under the exclusive responsibility of the customer.

14.6 You inform that, once the Exchange Transaction service is contracted, defined in item 7.1. of this, the nature of the services provided by you is defined in the terms described below:

15. Advantages of referring friends to HUSKY

15.1 We offer you the possibility to refer HUSKY to friends and, in return, you will gain benefits, which can be defined by a percentage discount on the fees we charge you or direct payment to your account as retribution for any direct referral from you. who use our services (cashback).

15.2 Any indication you make must register with HUSKY using a unique hyperlink, a specific URL, which we will provide you, or also by a coupon code that will also be informed. If your friend registers without using one of the two alternatives, we will not be able to identify that he was referred by you and, therefore, we will not be able to offer the advantages mentioned here.

15.3 You will see in the application information about all values (R$) that you receive as advantages of referrals from friends. These values will be updated whenever a friend referred by you receives payments from HUSKY.

15.4 For the sole purpose of preserving the privacy rights and banking secrecy of all our customers, we will not specifically report which friend received payments with HUSKY or even present analytical reports of how the amounts received by a friend were converted into benefits for you. We hope you understand our position in favor of an honest privacy policy and our great concern to preserve our customers' trust with HUSKY.

15.5 Whenever the advantages defined in pecuniary values (R$) are available to you for more than 30 (thirty) days, we will make a direct deposit in the individual account you have registered with HUSKY, zeroing the amount available until that moment.

16. HUSKY Obligations

16.1 We at HUSKY may use agents and service providers to assist us in delivering the Service to you. HUSKY manages, administers, and coordinates the Service. Among other functions, HUSKY provides customer service, and technology platform facilities for creating Accounts and monitoring Transactions, in addition to taking care of the delivery of funds to the bank accounts of the Final Beneficiaries in Brazil. HUSKY is a legal entity governed by Private Law, duly registered with the Board of Trade and the Federal Revenue, under the prudential supervision of the Authorities.

16.2 We at HUSKY are responsible for verifying customer identification in accordance with local laws, but we do not have the ability to guarantee full identification of the withdrawal of funds in the currency of origin and we do not even have the legal capacity to, if necessary, convert them. it in local currency, Brazilian Real (R$), sending it to the Final Beneficiary, as instructed by you. Such actions are managed by us in accordance with our partners, which are Financial Institutions duly registered for this purpose.

16.3 We at HUSKY are responsible, together with our partners, for storing the data of transactions and financial transactions made to our customers, in case it is necessary to present such acts with Brazilian bodies and entities.

17. Mandate

17.1 You, the Customer, pursuant to articles 653 to 691 of the Código Civil and, in compliance with the provisions of art. 117, the item I, of BACEN Circular 3.691, grants HUSKY powers so that it can perform, on its behalf, all acts necessary to contract foreign exchange operations, bank transfers, receipt of amounts, represent it before BACEN, and other financial and capital market institutions, with regard to contracted foreign exchange operations, in order to resolve any obstacles that make the delivery of the Service unfeasible.

17.2 This mandate is irreversible and irrevocable, and the obligations arising from it shall remain valid until all operations carried out by HUSKY on behalf of the CLIENT are settled.

17.3 This mandate may be used by HUSKY to contract foreign exchange operations if they are identified as the best alternative for receiving amounts from the customer.

18. HUSKY Intellectual Property

18.1 This mandate may be used by HUSKY to contract foreign exchange operations if they are identified as the best alternative for receiving amounts from the customer.

18.2 All content of the application and/or website, including name, brand, domain, programs, databases, files, texts, drawings, photos, layouts, headers, and other elements, was created, developed, and assigned to HUSKY, being, therefore, exclusive property of HUSKY or licensed to it and is protected by Brazilian laws and international treaties that deal with intellectual property rights.

18.3 Prohibitions: exploitation, assignment, imitation, copying, plagiarism, application of reverse engineering, attempted invasion (hacking), storage, alteration, modification of characteristics, expansion, sale, lease, donation, alienation, transfer, reproduction, in whole or partial, of any content on the HUSKY application and/or website.

18.4 The person who violates the prohibitions contained in the legislation on intellectual property and in these Terms will be liable, civilly and criminally, for the infringements committed, in addition to being able to be penalized on the HUSKY application and/or website.


19. General Terms

19.1 Communications. We are required to provide certain information to you in writing. By accepting this Agreement, you agree that we may communicate with you electronically, via email, or by posting notices on the HUSKY Website or Application that you have an account.

19.2 Events Outside Our Control. If we are unable to perform our obligations under this Agreement due to factors beyond our control, including changes in law, events of Force Majeure, withdrawal of a currency, or imposition of sanctions on a country or beneficiary, we will notify you as soon as reasonably possible and will use reasonable efforts to secure the return of any amount due to you in respect of which we have been unable to perform our obligations under this Agreement. We will not be liable to you if we are unable to perform our obligations.

19.3 Reclamation. Our commitment is to provide you with services of the highest standard. If you believe we have not met this standard, you can obtain information by contacting the HUSKY at friends@husky.io.

19.4 Complete Agreement. This Agreement, in addition to any document expressly mentioned therein, constitutes the entire agreement between us and supersedes any prior discussions, correspondence, arrangements, and understandings between us.

20. Applicable Law and Dispute Resolution

20.1 The provision of the Service and any controversy or claim arising from the provision of the Service is governed by Brazilian law and will be judged in the forum of São Paulo - SP, any other possible forum being revoked, even if of greater convenience for either party.

20.2 Any controversy or claim arising out of or in connection with the Service will be subject to the non-exclusive jurisdiction of the Brazilian courts. HUSKY may suggest that any dispute related to the Service be resolved by arbitration and may appoint an arbitrator or arbitration panel, in order to ensure greater speed and expertise in resolving the dispute between the parties. The decisions of any arbitration proceeding shall be final.

21. Limitation of Liability

21.1 You understand that HUSKY is under no obligation to process or finalize a Transaction if, for any reason, it is not possible to obtain authorization or settlement of funds from you for the value of the Transaction, whether due to pending documents, erroneous information provided by you or legal impediments to your CPF or CNPJ. You are also aware that HUSKY may reject your request for a Transaction, suspend or impose a transaction amount limitation without establishing just cause or providing you with prior notice if necessary.

21.2 You understand and agree that if your Transaction request is rejected for any reason, you will be informed of this rejection during your next access to the Application, by email, or by any other reasonable means of notification.

21.3 Although unlikely, if a Transaction is delayed or errors are made, HUSKY will correct the error or refund the requested Transaction amount, including the relevant fees. IN NO EVENT SHALL HUSKY BE LIABLE FOR PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR EXPENSES ARISING IN CONNECTION WITH THE SERVICE. In any event, any action brought by you in connection with the Agreement must be commenced within one (1) year from the date on which such cause of action occurs. In no event shall the liability of the parties exceed the amount of the payment sent and this shall be your exclusive remedy.

21.4 In consideration for providing the Service, you agree to indemnify and hold HUSKY harmless against any and all claims, losses, and costs in connection with or arising out of your use of the Service and your breach.

21.5 The HUSKY will always work for your benefit. However, we cannot be held responsible for delays, errors, or disputes to which you may become a party, and the Service is provided to you in its original form and as available, without the provision of any warranty.

21.6 Furthermore, HUSKY clarifies that it will be fully available to deliver to the competent authorities any and all documents that may be requested and that HUSKY has possession of. This is an essential condition for HUSKY's performance standards, ensuring that we do not measure efforts to help our customers and to prove how values were transacted, provided that the request is made respecting the due legal process and/or the conditions provided by law.

22. Modification and Contact

22.1 HUSKY reserves the right at any time to modify the clauses and conditions of this term, and the Customer, in the case you, in any case, must read and agree with its new conditions and obligations foreseen, an inseparable issue for the performance of such Services by HUSK.


23. Processing of Personal Data
